Rentals initiated on Violin Rental Direct.com (VRD), a subsidiary
of Voss Violins LLC, are subject to the following terms and
conditions:
RENTAL TERMS AND CONDITIONS EFFECTIVE 7/9/13
We encourage our customers to read these details carefully, and call us with any questions regarding our rental policies. In addition to these terms, we feel that it is important to offer new rental customers several common-sense precautions:
* NEVER perform repairs to your rental instrument! If you experience any mechanical issues with your rental, please call us as soon as possible for assistance. Excepting replacement of broken strings, repairs performed by yourself or a 3rd party may damage the instrument, and cause you to become liable for correction of the repair, or for the cost of the instrument. Most common problems can be easily fixed by our professional repair staff.
* Rent is due on the account until the instrument is returned to us. If the player of the instrument is no longer using the rental, please contact us for return instructions.
* If you received your rental outfit at a scheduled group delivery, please note that you may need to return the instrument to us directly. In some instances, you may need to return your rental to our shop, instead of to the delivery location. Returns can be completed either in person, or through shipping. Contact us for details when you are ready to return your rental.
FEE STRUCTURE AND PAYMENT POLICY
Rental fees must be paid in advance. Rent must also be paid for
the entire time an instrument is in the renter's possession, until
the instrument is returned to us, and regardless of whether or not
an Instrument is being used. Instruments may be rented on a
month-to-month OR on a 12-month basis.
An initial payment for a three month period is required in order to
open an account.
NOTE: Initial 3 months of rent is considered a minimum period and is non-refundable.
A 12-month instrument rental is also available. This plan
provides 2 bonus months, with a one time payment of 10-months. In
order to receive the bonus months at no charge, the entire 10-month
rental payment is required. Please note that these "free months"
have no cash value, and are void upon upgrade or
return.
In order to process your rental, we will require a valid credit
card number and a copy of your driver’s license.
Rental rates and the terms of this contract are subject to change
at the end of any rental period and without prior notice. Please
call us for an updated contract copy at any time.
EQUITY / PURCHASE PLAN
If the renter wishes to consider purchasing an instrument, we have the following purchase option: As a rental customer, 100% of the initial year's rental fees, plus 20% of rental fees paid during subsequent years of renting, can be applied toward the list price of any instrument sold by Voss Violins LLC not to exceed 60% of the list price of the chosen instrument, including the one that is currently rented. Instruments on consignment with Voss Violins LLC are excluded from this policy (Equity and Purchase Plan) as Voss Violins LLC does not own those Instruments. List price is based on current market value. Equity may not be combined with another rental's equity, and must be used within 60 days of the close of an account, or it will be forfeited.
PROTECTION PLAN
The renter will be responsible for our instrument, including
theft, loss, or damage (reasonable wear and tear as determined by
VRD is expected), until the instrument is returned.
If a Protection Plan is not purchased, the renter will be
responsible for the entire replacement cost as outlined in the
Rental Agreement.
VRD accepts the following liabilities if the renter purchases our
optional protection plan ($5.00/Mo., Standard violins and violas;
$7.00/Mo., Cello): Protection Plan will cover instrument outfit
maintenance and repair, and replacement of broken strings with
rental-quality strings. When the rental period expires, protection
plan coverage expires. Damage reported or observed is only covered
when protection plan and rental payment for the month has been
received. Protection plan is not in effect during air or overseas
travel. Protection plan will not cover: loss of an Instrument or
outfit component; theft of an instrument or outfit component from a
vehicle; heat damage to the varnish of an instrument; intentional
damage (scratching included); damage incurred while shipping; or
reimbursement for shipping costs of any sort. If an instrument
deemed uninsured is damaged, lost or stolen, we reserve the right
to charge the cost of repair or replacement to any credit card on
file. We reserve the right to be the sole judge of an instrument's
repair cost, replacement cost, and to perform or authorize any
repairs. If pre-existing damage is noticed on a rental Instrument,
please call us within 24 hours of receipt;
any damage observed after this time will be considered to have
occurred while in the renter's possession. In the event that an
instrument becomes damaged beyond reasonable repair, a replacement
instrument can be issued to you.
Destruction or theft of an instrument will result in a deductible
($250.00 for Standard Violins; $300.00 for Violas; and $800 for
Cello) being owed by the renter, followed by loss of coverage under
the protection plan. Deductible fees are due for payment when
damage or loss is reported or observed. Non-payment of a deductible
may result in your credit card being charged for the due amount.
Waive of protection plan will result in the renter being
financially responsible for payment of replacement or repair, as
deemed necessary by VRD.
A Police report will be required in case of theft.
Please note: equity accruals (see above) may not be used towards payment of a due deductible
A note on rental string replacement: VRD will only replace broken
strings free of charge. Extra strings or sets must be purchased
separately. False strings will only be replaced within 3 weeks of
issue of the rental. Substitution of string type will be at the
renter's expense. No reimbursement will be issued for strings
purchased elsewhere.
EXCHANGES
You may exchange your rental outfit at any time, for an instrument
of a different size. While there is no charge for exchanging
an instrument, please note that shipping fees (both outbound and
return) are the responsibility of the rental customer.
If you are not able to return the rental outfit immediately (for example, if you are requesting a new instrument via shipping), you will have two weeks to return your previous outfit to us. Please check your instrument case for any accessories and personal items before returning it to us (we are not liable for items left in instrument cases, such as shoulder rests, metronomes, and sheet music). Outfits that are not returned within two weeks from the date of exchange will incur a monthly rental fee until the outfit is returned in its entirety. In the event that an overdue outfit or component is not returned, your account will become liable for the full value of the instrument, until it is returned to us in acceptable condition. RENEWALS / RETURNS & REFUNDS / PAST DUE ACCOUNT POLICY
Returns & Refunds:
1) Return of instrument, which is not in exchange for another instrument, will result in cancellation of contract. Any costs due to damage or past due accounts are the responsibility of the renter and will be charged to the credit card on file.
2) Refunds – if the instrument is returned within 7 days of payment due date, the account will be refunded for that month’s rent, with the exception of the non-refundable initial 3 month’s rent.
Past Due Accounts: Rental payments made after the due date will be charged a $10.00 late fee per month, in addition to past due rent.
In cases of non-payment and/or relocation of the renter without a forwarding address, we reserve the right to charge the purchase price of the instrument, minus any equity, to any credit card on file. We reserve the right to use any remedy deemed necessary (including use of file credit cards, use of a collection agency, or by lawsuit) to take possession of unreturned rental instruments and to collect all past due rental fees, late fees, legal fees, due deductible, collection costs, and losses due to uninsured coverage. In the event of legal action or use of a collection agency, any fees associated will become the responsibility of the renter.

ACCEPTING POSSESSION OF A RENTAL INSTRUMENT CONSTITUTES
